Several lawsuits have now been filed over the Johnson & Johnson DePuy ASR hip implant which has been recalled worldwide after data revealed a very high failure rate.     There is quite a bit of evidence that DePuy in fact sold the dangerous ASR even though they knew about the potential defects with it. Consider that a full year before they recalled the device in the United States, DePuy withdrew the ASR from the Australian market (after data from Australian researchers showed a higher than expected failure rate). Even after warning doctors of the ASR dangers (citing the Australian research), it took months before a formal recall was issued by the company. This means more and more patients continued to receive a hip replacement unit that DePuy knew had a high risk of failure.
